GroFresh is a trading name of Kerala Super Mart LTD, a company registered in England and Wales. References to 'GroFresh', 'we', 'us', or 'our' in these terms refer to Kerala Super Mart LTD. Our website is grofresh.co.uk.
Using the site
These terms apply when you browse GroFresh and place orders for delivery within the UK. By creating an account or placing an order, you agree to these terms.
You must provide accurate account, billing, and delivery information and keep your sign-in details secure. You are responsible for activity carried out through your account unless that activity results from our error.
Orders, pricing, and availability
All products are subject to availability. Adding an item to your basket does not reserve stock. We may need to limit quantities, remove unavailable items, or cancel an order where stock, pricing, or verification issues arise.
We try to keep pricing, descriptions, weights, and pack sizes accurate, but packaging and manufacturer information can change. If a clear pricing error occurs, we may contact you before dispatch or cancel the affected item or order.
Product information and allergens
Product images are for illustration only. Please read labels, ingredients, storage instructions, and allergen information on the product you receive before use.
If you have a severe allergy or other dietary requirement, contact us before ordering and always check the packaging on arrival because recipes and manufacturing environments can change.
Delivery
Delivery dates and timeframes are estimates unless we clearly state otherwise. Delivery options depend on postcode, stock, weather, courier coverage, and the contents of your basket.
Someone should be available to receive chilled or frozen goods where required. Ownership of goods passes when payment is complete and the goods have been delivered to you. Your statutory rights are not affected.
Cancellations and refunds
If your order has not been dispatched, contact us as quickly as possible and we will try to cancel or amend it. Once dispatch has started, the order can no longer be cancelled or amended.
GroFresh does not accept product returns once an order has been delivered. As we sell groceries, this is consistent with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, which exempt perishable goods and certain sealed items from the 14-day cooling-off period.
Where an item arrives damaged, or with a use-by or best-before date that has already passed at the time of delivery, we will issue a refund. You must email hello@grofresh.co.uk within 7 days of delivery with your order number, clear photos of the affected item and its outer packaging, and a short description of the issue.
Where a delivery is attempted but cannot be completed because no one is available to receive it and you have not provided safe-place or alternative delivery instructions, responsibility for the order passes to you. We are not liable for the deterioration of chilled or frozen items in these circumstances, and it is your responsibility to arrange a redelivery or collection. You can nominate a safe place to leave your order when you book.
Nothing in these terms limits any rights you have under the Consumer Rights Act 2015 or other applicable UK consumer law. Goods supplied must be of satisfactory quality, fit for purpose, and as described, and your statutory rights in relation to faulty or mis-described goods are not affected by the time limit above.
Promotions and misuse
Promotions, offers, discount codes, and delivery thresholds can be withdrawn or changed at any time unless the terms of a specific promotion say otherwise. Offers cannot usually be combined unless we say they can.
We may suspend accounts, cancel orders, or refuse service where we reasonably believe there has been fraud, abuse, resale in breach of policy, or misuse of promotions.
Intellectual property
All content on this website including text, images, graphics, logos, and software is owned by or licensed to Kerala Super Mart LTD. You may not copy, reproduce, distribute, or create derivative works from this content without our written permission.
Product images, descriptions, and brand assets relating to third-party suppliers remain the property of those respective brands.
VAT and pricing
Prices shown on the site include VAT where applicable. Some food items are zero-rated for VAT under UK law. The applicable VAT treatment is applied at checkout and shown in your order confirmation.
Data protection and privacy
We process personal data in accordance with the UK GDPR (the retained EU General Data Protection Regulation as it forms part of UK law) and the Data Protection Act 2018. Kerala Super Mart LTD is the data controller for personal data collected through grofresh.co.uk.
Our Privacy Policy explains what data we collect, how and why we use it, the lawful bases we rely on, how long we keep it, and the rights you have — including the right to access, correct, or erase your data and to complain to the UK Information Commissioner's Office (ICO).
